OPEN LETTER TO THE ARIZONA LEGISLATURE, AND CC TO SUN CITY, AZ

"LIAR GRAY LEADS REPUBLICANS TO RUIN THE PLANNED COMMUNITIES ACT" by Anne Randall Stewart, Spokesperson for The Sun City Formula Registry and Publisher of annereport.com

Subject: This opinion piece exposes the lies perpetuated by Republican Rick Gray and RCSC General Manager Jan Ek in order to get RCSC pulled out of the planned communities act.  They want CLOSED MEETINGS AND CLOSED RECORDS!  They want to discredit a respected Superior Court Judge's ruling that RCSC is under the Act since 1994.  They are trying to escape facing the consequences of disobeying the Act since its inception.  DO NOT BE DUPED! VOTE NO ON SB1094!

"RCSC---Misinformation being sent to residents" by Anne Randall Stewart, Spokesperson for The Sun City Formula Registry and Publisher of annereport.com

Subject: This opinion piece exposes Jan Ek's corporate email blast as misinformaiton to get support for House Bill 2374.  Ek claims if the bill RCSC wrote doesn't pass RCSC will lose the 55+ age overlay.  A LIE!  Truth is if it passes RCSC will not be under the Planned Communities Act even though a Judge said they were.  They do not want to comply and they want to stop our lawsuit that compels compliance.  DO NOT BE DUPED! VOTE NO ON HB2374!

"Bill attempts to get RCSC off the hookby Anne Randall Stewart, Spokesperson for The Sun City Formula Registry and Publisher of annereport.com

Subject: This opinion piece is against Senator Debbie Lesko's bill SB1175 that is an attempt to interfere with our class-action lawsuit against the RCSC regarding the legality of charging the Preservation and Improvement fee.  The bill makes it legal RETROACTIVE to 2010!  Lesko is taking sides against the homeowners.  She doesn't have enough information to justify doing that.  Call the House of Representatives (click here for contact information) and tell them to vote NO on SB1175.  Let the court decide.

"No indebtedness, no miracle" by Anne Randall Stewart, Spokesperson for The Sun City Formula Registry and Publisher of annereport.com

Subject: Rebuts RCSC James Brasher's April 24 Daily News-Sun guest commentary entitled, "Miracles without debt," which is no miracle since RCSC just takes the money it needs (and more) directly from the homeowners, buyers, and beneficiaries, at $3,000 a pop.  RCSC has increased assessments and is proceeding with more multi-million-dollar projects without a membership vote. Subject: Opinion points out that RCSC General Manager Jan Ek's defenders are former RCSC board members who directly caused our class-action lawsuit because they voted to illegally increase the quorum for membership meetings.  Also, points out that strident critic Amber Henshaw can't be found in the white pages, isn't listed on Maricopa County's property tax rolls, and doesn't have an RCSC Facilities Agreement that we could find.  Ergo, the question: "What's her axe to grind?"

Subject: Without an open meeting, the RCSC board "voted" to repair the Sundial Monument instead of demolish the Del Webb icon.  That is a victory for the Members.  However, we must hold off on our celebration.  Without a public vote, board decisions are not official.  Our petition drive isn't over yet.  Stand by until the board's decision is official.  No demolition can proceed while there is a request for a petition for membership action through a Membership Vote.  See PRESS RELEASE BELOW.

"Sundial Monument rust a ruse" by Anne Randall Stewart, Spokesperson for The Sun City Formula Registry

Subject: Without discussion in an open meeting, the RCSC board had a press release that because of rust on the Sundial Monument it will be removed, citing an engineering report that it is "unsafe".  We found that to not be the case; the steel frame is not any rustier than the new steel found at a construction site.  The steel is still good.  The Sundial Monument is a historic landmark and namesake for the Sundial Rec Center.  It is an icon and necessary for the branding of Sun City.  The Del Webb history is important to perpetuate "Our Retirement Dream Come True".  After this letter was circulated, and others generated from member outrage, the board released a second notice that backed off saying they don't have enough information to tear it down and is requesting "input".  We don't trust them.  Leave the Sundial Monument where it is and take care of it.  And start having open meetings so we don't upset the membership.

PUBLISHED DAILY NEWS-SUN, NOVEMBER 25, 2010, OPINION, LETTERS, PG 6A

UPDATE 12/21/10: BROWN LOSES!!!  SUN CITY WINS!!!

However, AFTER THE ELECTION OUTCOME, Director Phil Cook resigned so that the board can appoint someone to take his place.  Is he being a "team player" by resigning?  Will the board have the "gall to install" Craig Brown thereby OVERRIDING the will of the people?

UPDATE 1/26/11: SUN CITY LOSES!!!  BROWN WINS!!!

The appointment was Carey Shore, same as Brown.  Both voted to increase the PIF to $3,000 after membership quorums showed up to protest.  Both voted to increase the quorum for membership meetings against state statute so that the members can't ever have a quorum again!  Shore equals Brown, so, Brown wins and Sun City loses!

"Registry fights community apathy" by Anne Randall Stewart, Spokesperson for The Sun City Formula Registry

Subject: Rebuttal to critic Robert Wheeler's letter against SCFR.  Wheeler in uninformed.  The Registry faces apathy which is a "soothing state of mind.  Dangerous, but soothing, like dope."  Addresses charge that the Registry is trying to change Sun City by giving examples of the sweeping changes this board has done to remove membership power.  The Registry merely wants to restore that power to the members.

"Registry rejects recall petition 'as to form and timing'" by Anne Randall Stewart, Spokesperson for The Sun City Formula Registry

Subject: Gives the history of events regarding the petition drive.  Also, explains the reasons for rejecting the recall petition [Petition P-03] and the intent to proceed on Oct. 1st when the homeowners return.  The RCSC board has written bylaws and board policies that have removed the ability for the Members to act which is contrary to the RCSC Articles of Incorporation.  They guarantee that in a dispute between the Members and the board over the bylaws, etc., "the action of the Members shall prevail."

Subject: Call to action to attend Thursday, Nov. 19, 9am RCSC quarterly membership meeting where Noel Kasper will make motions to circulate petitions that will bring to a vote to amend the RCSC articles of incorporation.  If brought to a ballot vote and approved, the changes would remove the board's power to recall directors or write bylaws and board policies without a membership vote   There is an explanation about the need to change the wording in the Planned Communities Act to conform with the "common area" tax exemption by asking District 9 representatives Rick Murphy and Debbie Lesko to sponsor a bill to get this done.  All members must attend this VERY IMPORTANT MEETING at Sundial auditorium at 14801 N. 103rd Ave.  VOTE TO ALLOW THE PETITIONS!!!

"Creek project too costly" by Anne Randall Stewart, Spokesperson for The Sun City Formula Registry
THE SUN CITIES INDEPENDENT, Letters, Page 4A, April 8, 2009
Subject: RCSC board wants gutters on Willowcreek costing $435,000.  Stewart wants Pacific Aquascape to be able to bid on the project to keep Willowcreek Del Webb quality.  She fears they will be shut out by specs calling for a gutter which they don't do.  If they are, Stewart calls for recall of board members and dismissal of employees in support of it.
UPDATE: Pacific Aquascape was shut out of bidding.  On Monday, at the 4/6/09 board meeting, Tom Beckwith delivered a PA bid for $203,000 or $308,000 depending on the length, which was immediately rejected.
So, Willowcreek will get a gutter instead of a water feature and it will be done by Alliance, a first-time contractor, with no identifiers on their trucks at the construction site.

"Reversal moves to regaining members' faith" by Anne Randall Stewart, Spokesperson for The Sun City Formula Registry
Subject: RCSC board's reversal of their proposed decision to close down the delis is a beginning to reversing the loss of members' faith that they are protecting the members.  That faith has been systematically eroded by board members and management not telling the whole truth, coupled with board policies removing member power and oversight.
